New Medicare Observation Status Appeals Processes

This free webinar will explain new rights of appeal gained from a national class action suit by the Center for Medicare Advocacy, Justice in Aging, and pro bono law firm Wilson Sonsini Goodrich & Rosati. The presenters include one of the litigators who won these rights for people reclassified from inpatient to observation status. A Q&A session will follow.

Medicare enrollees who are classified as observation status during a hospital stay cannot access Medicare coverage of nursing facility services. Instead, they must either pay out-of-pocket or forgo these medically necessary services altogether.

Retrospective appeals became available January 1, 2025 and will go back to January 1, 2009.

Prospective appeals will be possible starting Febrary 14, 2025, for people who are in the hospital and want to appeal their reclassification from inpatient to observation.

It is our understanding that the new rights apply only to original Medicare, not Medicare Advantage plans. (It is possible to switch back to original Medicare during open enrollment periods – but not retroactively.)
